Terms and Conditions

Blue Waves Swim School ("we") reserves the right to change these general rules and policies from time to time by posting updated policies on our website, yourbluewaves.ca (the "site"). You acknowledge and agree that it is your responsibility to review the website and the policies periodically to learn of any modifications. Your continued enrollment in the program after the posting of any modifications shall constitute your agreement to be bound by such modified policies.

Payment

Participants agree to be charged on a weekly basis for the student's swimming lessons. The amount will vary based on the number of weeks within the month. If a card is not stored on file, Blue Waves will inform the family of the outstanding amount. If the payment is not received by the new requested date, the student will be removed from the schedule, and the spot will be released and become available for other customers to register.

Payment must always be completed 1 (one) month in advance before lessons occur.

Withdrawal Policy

By enrolling, you commit to the full duration of the registered session. No refunds, cancellations, or early withdrawals will be granted once registration is confirmed.

General Policies

In the event of instructor absence, a substitute may be assigned without notice.

If your child is ill, especially with a fever or contagious condition, please keep them home to protect the health of others.

We reserve the right to remove any swimmer or parent who does not comply with our policies.

If you arrive late for a lesson, please note that classes will end at their scheduled time and cannot be extended. If a full lesson is missed, make-up lessons are encouraged (when eligible).

We reserve the right to consolidate or cancel classes at our discretion.

Children under age 3 or those who are not fully potty-trained must wear a snug-fitting reusable swim diaper over a disposable swim diaper while in the pool. Reusable diapers are available for purchase on-site if needed.

Please check your child’s diaper or have them visit the restroom before their lesson begins.

Parents/guardians are responsible for supervising their child(ren) outside of lesson times. We do not supervise the change rooms or other facility areas. All users must follow posted age and gender guidelines.

Personal belongings must be stored in lockers. The facility is not responsible for lost or stolen items.

If your child fouls the pool, you will be held responsible for any damages and cleaning costs incurred. Charges will be determined at the facility’s sole discretion and invoiced via email.

Billing Authorization

We require that a credit card or debit card be on file. 

Lessons are billed on the 1st or 15th of every month depending on your tuition schedule.

If payment fails, you will have until the 10th of the month to provide payment or you will be withdrawn from lessons with no guarantee of returning to the same day, time, or instructor.

Should your child's class fall on a holiday, we prorate tuition accordingly.

No refunds or credits will be issued.

By agreeing to the Billing policy, the client authorizes Blue Waves Swim School to charge their credit card on a monthly basis for the services provided by Blue Waves Swim School. The client understands and agrees that the charges will be automatically applied to the provided credit card on the first day of each month.

Waiver

As legal guardian of my designated student(s) (student(s)), I hereby consent to all student(s) participating in this facility's program(s). I recognize that potentially severe injuries can occur in any activity involving height or motion, including swimming and physical activity in general. I understand that it is the express intent of all staff and personnel to provide for the safety and protection of my student(s) and, in consideration for allowing my student(s) to use these facilities, I hereby COVENANT NOT TO SUE and FOREVER RELEASE this facility, affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, owners, directors and other members involved in this facility's program(s), from all liability and for any and all damages and injuries suffered by my student(s) during instruction, supervision, and/or control during any and all classes or extra activities.

Make-Up Lesson Policies

If you need to miss an upcoming lesson, please notify us by email only with at least 24 hours’ notice. Make-up lessons will only be offered when the absence is reported via email and the missed class has been paid for.

To request a make-up class, email us with your child’s name and your full availability. We will provide available options within the same calendar month as the missed class.

Each swimmer is eligible for one free make-up lesson per month for excused absences.

Swimmers must be actively enrolled in weekly lessons to be eligible for make-up classes.

Make-up lessons have no cash value, are non-transferable, and cannot be rescheduled once booked.

 

​​Photo & Media Waiver

By participating in programs at this facility, you authorize us to take photographs and/or videos that may include images of your child(ren) for internal use or promotional purposes.

Your acceptance of this policy via electronic signature or button press is considered legally binding and equivalent to a handwritten signature. You may download or print a copy of these policies after accepting.

Blue Wave Swim School Inc. — Pool Party Terms and Conditions

1. Booking, Payment, and Deposit

1.1. A $100 non-refundable deposit is required at the time of booking to secure your party date and time.
1.2. The remaining balance is due prior to the start of the event.
1.3. In the event that Blue Wave Swim School Inc. must cancel the party due to unforeseen circumstances (e.g., pool maintenance issues, equipment malfunction, or other operational problems), a full refund will be provided, including the deposit.
1.4. If you need to cancel your event:

• Cancellations made at least 72 hours prior to the scheduled event will receive a refund minus the $100 non-refundable deposit.

• Cancellations made less than 72 hours but more than 24 hours prior to the scheduled event will receive a 50% refund of the total amount paid.

• Cancellations made less than 24 hours prior to the event will not qualify for any refund.

2. Party Duration and Time Limits

2.1. Clients must adhere strictly to the time limits outlined in the package they selected.
2.2. Your scheduled booking includes both pool time and party room time. Please ensure your guests arrive and depart within your designated time frame.
2.3. Exceeding your scheduled time may result in additional charges or loss of future booking privileges.

3. Safety Rules and Supervision

3.1. A certified lifeguard will be on duty for the duration of your booked pool time.
3.2. The lifeguard is responsible for supervising swimming activities for up to 15 people in the pool at one time.
3.3. If there are more than 15 swimmers (up to a maximum of 30), a second lifeguard will be required and provided by Blue Wave Swim School Inc. at an additional cost.
3.4. All guests must follow lifeguard instructions and posted facility rules at all times. Failure to comply may result in immediate termination of the event without refund.
3.5. Children under 7 years old must be accompanied in the water by a guardian over the age of 18.
3.6. Children 3 years of age and under must wear a swim diaper while in the pool.
3.7. Parents, guardians, and hosts are fully responsible for supervising their children and guests outside of the pool area, including:

• The pool deck

• Party room

• Change rooms

• Washrooms

• Parking lot and outdoor areas of the facility

4. Allergies, Food, and Beverages

4.1. Clients are welcome to bring their own food and beverages.
4.2. Blue Wave Swim School Inc. does not assume any responsibility for food allergies, sensitivities, or adverse reactions among guests. It is the client’s responsibility to ensure that all foods and beverages brought on-site are safe for their guests.
4.3. Alcohol and smoking are strictly prohibited on the premises.

5. Music, Media, and Equipment Use

5.1. Clients are welcome to use our electronic devices for music or videos, including our TV and audio system.
5.2. Clients are fully responsible for any music, videos, or other media they play during their event.
5.3. Blue Wave Swim School is not liable for any offensive language, imagery, or content in the media played.
5.4. Clients agree to ensure all content remains appropriate for a family-friendly environment.

6. Conduct and Facility Rules

6.1. All guests must treat the facility, staff, and equipment with respect.
6.2. Any damage caused to property, equipment, or furnishings during the event will be the financial responsibility of the client.
6.3. The client and all guests must abide by all posted rules and lifeguard instructions at all times.
6.4. Blue Wave Swim School reserves the right to remove any individual or terminate the event without refund if behavior is unsafe, disrespectful, or violates facility rules.

7. Liability and Waiver of Claims

7.1. Participation in swimming and related activities carries inherent risks, including but not limited to slips, falls, drowning, allergic reactions, or other injuries.
7.2. By signing this agreement, the client and their guests acknowledge and voluntarily accept all risks associated with the use of the pool, party room, and facility.
7.3. The client agrees, on behalf of themselves, their guests, minors in attendance, and their respective heirs or representatives, to waive, release, and discharge Blue Wave Swim School Inc., its owners, employees, contractors, and affiliates from any and all claims, liabilities, demands, or actions arising from participation in the pool party, including injury, illness, property damage, or death.
7.4. This waiver applies to all areas of the facility, including the pool, pool deck, party room, washrooms, change rooms, and parking lot.

8. Photography and Video Release

8.1. Blue Wave Swim School Inc. may, from time to time, take photographs or videos during pool parties for promotional, marketing, or educational purposes (e.g., social media, website, brochures).
8.2. By signing this agreement, you grant Blue Wave Swim School Inc. permission to photograph and/or record you and your guests, including minors in your care, during the event.
8.3. You authorize the use, publication, and reproduction of such photos or videos in any medium for lawful purposes without compensation.
8.4. If you do not consent to photography or video recording, please inform our staff in writing prior to your event so that we can ensure your request is respected.
